TERMS AND CONDITIONS FOR LONDON'S MILLION PIXEL SPHERE
Last Updated: October 2026
Welcome to London's Million Pixel Sphere (the "Site"). By purchasing a digital slot, tile, or pixel (a "Pixel Block") or using this website, you agree to be bound by these Terms and Conditions. Please read them carefully before making a purchase. You must tick the box confirming you accept these Terms and Conditions before you can pay.
1. The Nature of the Platform
• Independent Project: London's Million Pixel Sphere is an independent, 3D digital art and local advertising project. It is a neutral hosting platform for user-generated content.
• No Physical Affiliation: This Site is entirely digital. It is not affiliated with, endorsed by, or connected to Sphere Entertainment Co., Madison Square Garden (MSG), or any physical entertainment venue or proposed real-world construction in London or elsewhere.
• The Sphere: The sphere contains 1,000,000 Pixel Blocks. Each Pixel Block costs £1 (GBP). One order may contain up to 20,000 Pixel Blocks. You may choose several areas and either span one picture across them or repeat the picture in each area. Purchasing buys a digital display allocation, not ownership of the Site or any physical asset.
• Pre-existing Artwork: The Site operator reserves the right to occupy portions of the sphere (including the initial 60,000-pixel promotional title) for branding, aesthetics, and site navigation purposes. These pixels are not available for public purchase.
2. Accounts and Privacy
• Accounts Are for Buyers: An account is created at checkout when you place an order. You must provide your full legal name and an email address, and confirm your email address through the verification link we send you. The "My Account" page is for signing in only.
• Your Password: Keep your password confidential. Passwords are stored securely and cannot be viewed by administrators or other users. Password recovery is handled through an emailed reset link.
• Private Information: Your email address, account details and order history are visible only to you and authorised administrators. No other user can see them. Approved artwork and its website link are public on the sphere.
• Game Leaderboard: The only names shown publicly are the names players choose to type in after a game to enter the leaderboard. Your account name is never used on the leaderboard.
3. Purchase and Approval Process
• Surface Area Equality: Pixel Blocks vary in geometric shape across the 3D sphere due to mathematical formatting, but all single Pixel Blocks are sold as having almost exactly the same proportional surface area. By purchasing, you accept the unique geometric shape of your allocated slot.
• Required Details: A successfully uploaded picture and a valid website link are required before checkout.
• Holding Pixels: Selecting pixels alone does not reserve them. When the payment form opens, your pixels are held for up to 7 minutes. If someone else has already bought or is paying for those pixels, you cannot proceed and will be asked to choose different pixels.
• Stripe Payment Processing & Cross-Border Fees: All financial transactions are processed securely via our third-party merchant provider, Stripe. All base transactions are executed in British Pounds Sterling (GBP). If you are purchasing from outside the United Kingdom, Stripe or your local credit card issuer may apply automatic currency conversion rates and international transaction fees. The Site operator is not responsible for these merchant-applied charges, and they are entirely non-refundable. Your bank statement may show LINK.COM*.
• No Card Details Stored: The Site never stores your card number, security code or billing details, and administrators cannot view them.
• Taxation: The advertised purchase price per Pixel Block is inclusive of any applicable UK Value Added Tax (VAT) or local digital service sales taxes processed at the point of sale via Stripe.
• Immediate Supply Means Reservation, Not Publication: As soon as payment is confirmed, your purchased Pixel Blocks are allocated to your order and show as yellow with "RESERVED"; your account shows "Pending approval". This is the immediate supply of your reserved digital allocation. It does not mean your picture, logo, business name or website is approved or displayed immediately. Your business becomes visible only after administrator approval.
• The Approval Queue: Allow up to 72 hours from each completed submission or re-submission for the administrator to review it and approve it or explain why it has been rejected. Review covers the picture or logo, business name and linked website together; approval applies to all of them, not just the artwork. Any of these may cause rejection, including a destination that does not exist, does not lead to a working website, appears malicious, or breaks these terms. Before approval, the administrator will make reasonable checks to confirm that the destination website exists and to assess apparent safety and compliance. These checks are not a guarantee of safety, accuracy or legality.
• Business Identity Requirement: To maintain the commercial and artistic integrity of London's Million Pixel Sphere, all uploads must feature a clear website name, business name, or corporate brand logo. Submissions that fail to clearly represent an active business, commercial venture, creative project, or organization will be rejected during the approval phase.
• Rejections and Re-uploads: If your picture is rejected, you will be told the reason and may upload a replacement through your account. If submissions repeatedly break these terms, the administrator may cancel the order without a refund, and its pixels become available to others.
• Post-Game Advertisement Rotation: Approved businesses receive additional promotional exposure via the ad panel displayed at the conclusion of each gameplay session. The selection is automated and strictly randomized: every approved business on the sphere has an equal probability of being displayed, regardless of the size or number of Pixel Blocks purchased. These ad impressions carry zero independent cash value.
• Finality of Sale and Permanent Lock: Once your submission is approved and published live on the sphere, no edits, swaps, or modifications to the graphic, business name or URL are permitted by the user. At checkout you request immediate performance, beginning with reservation of your Pixel Blocks, rather than immediate publication. Our policy is no change-of-mind refunds, subject to applicable law. Reservation alone does not automatically remove any statutory cancellation right: any loss of that right depends on the legal classification of the purchase and the consent, acknowledgement and performance required by law. Nothing in these terms excludes mandatory cancellation or refund rights, including rights where the service is not provided as described.
• Discretionary Modification Requests: If a purchaser requires an emergency update (e.g., due to a major rebrand), they cannot edit it themselves. They must directly email the administrator at hellomillionpixel@million.com using the exact email address associated with the original purchase account. Requests from different email addresses or channels will be ignored. The Site administrator makes no guarantees that requested updates will be implemented, and users must allow a reasonable, indefinite timeframe for a response or manual update.
4. Intellectual Property & User Warranties
• Review Before Publication: Every picture or logo, business name and linked website is sent to the administrator for approval before publication. Until the submission is approved, your Pixel Block or Pixel Blocks show as yellow with "RESERVED". Allow up to 72 hours for each submission's review. Approval does not mean the operator endorses your business or guarantees that your content is lawful.
• Your Warranty: By uploading any image, logo, or trademark, you explicitly warrant and guarantee that you are the legal owner of that intellectual property, or that you possess explicit written permission from the trademark/copyright holder to use it.
• Indemnity: You agree to fully indemnify, defend, and hold harmless the owner and operator of London's Million Pixel Sphere from and against any and all claims, liabilities, damages, losses, or legal costs arising out of any copyright or trademark infringement caused by your uploaded content.
5. Notice and Takedown Procedure (72-Hour Window)
• Designated Reporting Channel: If a brand owner, business entity, or individual believes that an approved, live pixel graphic infringes their intellectual property or constitutes an unauthorised brand promotion, they must formally report it exclusively via our official Contact Page Form. Reports submitted through social media or unofficial email channels will not be processed.
• Mandatory Proof of Ownership: To prevent malicious or fraudulent takedown requests, all reports must include verifiable proof of ownership or authority matching the disputed content, such as legal business registration, trademark registration, copyright ownership, or other reasonable evidence. Anonymous reports or submissions lacking reasonable, verifiable proof will be discarded immediately without investigation.
• 72-Hour Resolution Window: Upon receiving a valid, fully completed report accompanied by legitimate proof of ownership, the Site administrator will investigate and take appropriate action—which may include the temporary masking or permanent removal of the offending pixel graphic—within 72 business hours.
• Forfeiture Without Refund: If your Pixel Block is removed or altered due to a verified intellectual property violation or breach of these terms post-approval, your slot will be blanked out, and you will forfeit your purchase without any right to a refund.
6. Prohibited Content, Links, and Post-Approval Changes
The Site operator maintains a strict zero-tolerance policy. You are explicitly prohibited from uploading, or linking your Pixel Block to any external website that contains:
• Pornographic, adult, or sexually explicit material.
• Hate speech, harassment, defamation, or discriminatory text/imagery.
• Gambling, scams, phishing networks, malicious code, or illegal marketplaces.
• Copyright-infringing download links or pirated media.
• Personal faces or selfies, unless the face is legitimately part of an official commercial logo and you have the required rights.
• Post-Approval Content Shifts: You explicitly agree that you will not alter, redirect, or swap the contents of your destination website to host any of the prohibited material listed above after your link has been approved by the administrator.
• Responsibility for External Websites: External websites are operated by their respective owners, not by this Site. Their owners remain responsible for their content, products, services, security and subsequent changes, whether that content existed before approval or was uploaded or changed afterwards. Although reasonable checks will be made before approval to confirm a destination exists, approval is not an endorsement or a promise that the website is safe. To the extent permitted by law, the Site operator accepts no responsibility or liability for external website content or loss arising from visiting it, before or after approval. Nothing in this clause excludes responsibility or liability that cannot lawfully be excluded.
• No Duty to Continuously Monitor: The Site operator operates as a neutral hosting provider and is under no legal obligation to continuously check or monitor external websites after initial approval. If an external website is found to have changed its content to violate these rules post-approval, the corresponding Pixel Block will be permanently deleted and blocked immediately upon discovery or user report.
• Removal After Approval: Approved graphics cannot be deleted through the routine admin area. Removal of an approved graphic for a breach of these terms is carried out manually by the Site operator only.
• Penalty for Breach: In the event of a post-approval violation, the purchaser permanently forfeits their Pixel Block, their account will be terminated, and no refund will be issued. The original payment will be retained by the operator to cover administrative and disciplinary costs.
• Dead Links and Continued Presence: If your destination website simply goes offline or becomes a dead link naturally without violating our safety rules, your pixel graphic will remain permanently locked onto the sphere. The Site operator is under no obligation to fix or monitor link decay, and no refunds or automatic edits will be provided for dead destinations.
7. Limitation of Liability and "As-Is" Clause
• No Traffic Guarantees: While the Site is designed for high visibility, we make no guarantees, warranties, or promises regarding the amount of web traffic, clicks, or commercial revenue your Pixel Block will generate.
• Technical Maintenance & Scheduled Downtime: The Site is provided on an "as-is" and "as-available" basis. The operator reserves the absolute right to temporarily place the platform on hold, restrict access, or take the site completely offline for occasional technical maintenance, database updates, bug fixes, or server optimization. There is no maximum length of time for which the Site may be on hold or offline for maintenance. You explicitly agree that operational downtime or maintenance holds, however long, do not constitute a breach of contract and do not entitle any purchaser to financial compensation, extensions, or refunds. The operator is also not liable for unplanned service interruptions, server crashes, WebGL graphics rendering failures, browser crashes, input delays on desktop or mobile devices, or internet outages.
• Gaming Performance & High-Score Leaderboards: The 3D survival game mode is provided strictly for entertainment purposes. Only escape times against the computer are recorded on the leaderboard. The Site operator is not legally or financially liable for any data loss, temporary lag, or glitch affecting the public high-score leaderboard. High scores do not constitute intellectual property, carry no monetary value, and the operator reserves the right to wipe, reset, or moderate the leaderboard at any time without notice to prevent cheating, offensive names or automated bot inputs.
• Clustering and Display Layouts: While purchasers may buy multiple adjacent Pixel Blocks to display a unified larger image, the Site operator retains ultimate creative control over the overall rendering performance. If a large cluster causes browser crashes or degrades the user interface for other visitors, the operator reserves the right to work with the buyer to optimize or scale the image assets.
• Platform Lifespan and Retirement: While the operator intends to maintain London's Million Pixel Sphere as a long-term digital archive, we guarantee a minimum live operational online lifespan of two (2) years from the official public launch date (October 2026). Following the expiration of this two-year period, the Site operator reserves the absolute right to archive, migrate, transfer ownership of, or decommission the platform and server data without further notice or financial liability to previous purchasers.
8. Cyber Security, Hacking, and Law Enforcement
• Malicious Attacks and Hacks: While the Site operator implements standard security measures to protect the platform, you explicitly acknowledge that no internet platform is completely secure. The Site operator is not legally or financially responsible for any website hacks, data breaches, malicious defacement, server intrusions, or unauthorised alterations to the sphere caused by third-party cybercriminals or hackers. In the event of a breach, the operator will make reasonable commercial efforts to restore backup data swiftly, but you will not be entitled to compensation for lost visibility, damaged graphics, or altered hyperlinks.
• Law Enforcement & Government Cooperation: The Site operator maintains a policy of absolute cooperation with legal authorities. If requested or ordered by law enforcement agencies, courts, or government bodies during an active investigation, we will fully comply and disclose any required platform data. This includes, but is not limited to, account registration data, purchase history, payment logs, IP addresses, uploaded files, or documents submitted via our report forms.
• Reporting of Fraudulent Activity: We reserve the right to proactively report suspicious activity to law enforcement or relevant fraud prevention bodies. If an individual or business submits forged corporate credentials, fraudulent trademark certificates, or fake identity documents through our Contact Form, or attempts to purchase slots using stolen financial instruments, we will immediately report this data to the authorities.
• Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this Site shall be subject to the exclusive jurisdiction of the courts of England and Wales.
